REGISTRATION TERMS AND CONDITIONS
These Registration Terms and Conditions (“Terms”) set out the terms applicable to you (the “Institute” or “you”), in relation to the your registration to and participation in the Reliance Foundation Youth Sports (“RFYS”, “we”, “us”) conducted tournaments and leagues (together the “Tournaments”).
By clicking the ‘I Accept’ tab hereinbelow, the Institute agrees to abide by these Terms and further accepts these Terms on behalf of itself as well as its students participating in the Tournaments (“Students”).
Please review the Terms carefully prior to registration.
1. Registration Process
Your participation in Tournaments is subject to your completion and submission of your registration form (in the format as prescribed by RFYS). The registration form may be completed and submitted along with any supporting documentation specified/requested by RFYS. The Institute represents and warrants that any and all documentation and information submitted hereunder is true, valid and accurate to the best of the Institute’s knowledge, and the Institute has not knowingly misrepresented any facts to RFYS. It is clarified that RFYS may at its sole discretion, approve or reject the submitted registration form.
The Institute agrees and acknowledges that RFYS shall be entitled but not obligated to conduct an independent assessment of the Students’ eligibility prior to the Students participating in the Tournaments.
2. Institute’s Obligations
The Institute agrees that, it shall, and shall cause the Students to, during the Term (defined below):
- act in accordance with all lawful and reasonable instructions of the RFYS personnel, as well as regulations and plans that are communicated;
- observe the rules and regulations in force for the relevant sport, including, without limitation, those of the World Anti-Doping Agency and the National Anti-Doping Agency, in addition to, and not in substitution of, the Regulations (as defined herein);
- ensure the Students submit promptly to such medical examinations as RFYS may reasonably require and to undergo such medical treatment as may be prescribed by the medical advisers of RFYS;
- make use of sports equipment strictly in compliance with the Regulations at all times;
- be responsible for the Students’ personal property, including money or other valuable items as RFYS takes no responsibility for the loss or damage to a Student’s personal property; and
- undertake such other duties and participate in such other activities as are reasonably required of the Institute.
3. License
The Institute hereby grants RFYS and agrees to procure the grant to RFYS of an irrevocable, royalty-free, sub-licensable, right and license, on worldwide basis, to:
- use the Institute’s name, logo, motto and other intellectual property marks (“Institute Marks”) as RFYS deems fit, for the promotion of RFYS, its Tournaments, and its sponsors and partners during the Term and anywhere in the world, and on any medium physical, broadcast or digital (including on the internet and social media) or any other media which may become known in future;
- use the Students’ name, reputation, pictures, nickname, fame, image, shirt number, signature, voice, audiovisual recording, and any other portrayal or characteristics of any kind of the Student while involved in activities relating to the Tournaments and RFYS (“Student Identification”), as RFYS deems fit, for the promotion of RFYS, its Tournaments, and its sponsors and partners during the Term and anywhere in the world, and on any medium physical, broadcast or digital (including on the internet and social media) or any other media which may become known in future;
- photograph and/or record on video the Students both individually and as a member participating in the Tournaments when they are involved in activities relating to RFYS, during the Term;
- film, televise, photograph, identify and otherwise record the Students and their performance during all training sessions and periods ancillary thereto, including in Tournaments; and
- use in perpetuity, the content created by RFYS during the Term which features and/or utilises the Student Identification, for the purpose of the promotion of RFYS and/or the Tournaments on any medium physical, broadcast or digital (including on the internet and social media) or any other media which may become known in future.
The Institute hereby agrees not to raise any claims or complaints in respect of the grant of license as specified herein, and waives any right to inspect or approve any use of the license granted to RFYS. Further, the Institute, on behalf of the Students waives all moral rights and personality rights under applicable law, including any right to have the Students’ names affixed to each usage of the Students’ image, to the extent permissible under Indian law.
4. Representations and Warranties
The Institute represents and warrants as follows:
- Each Student registered by the Institute to participate in the Tournaments is and shall be a bonafide student enrolled at the Institute for the current academic year as a full-time student. The Institute shall notify RFYS of any change in status of any Student no later than seven (7) days.
- The Institute hereby acknowledges, agrees and understands that there is a certain amount of risk involved in engaging in training and playing matches for a physical sport, and that the Institute on behalf of the Student hereby waives any and all claims of any nature whatsoever howsoever arising against the RFYS and its personnel, employees, and representatives that might result from conducting the Tournaments and allied activities thereby, whether on account of illness, injury or otherwise.
- The Institute hereby represents and warrants that each Student is fit to play the sport, and does not have any pre-existing medical condition, ailment or injury preventing the Student from doing so.
- The Institute represents and warrants that it understands the risk of injury associated with participating in sports, and agrees to assume such risk in connection with the Students’ participation in the Tournaments.
- The Institute warrants and confirms to RFYS that it has made and shall make in a timely manner a complete and honest disclosure to RFYS of the Students’ past and current medical history (including, but not limited to, all injuries suffered, medical conditions and treatments) and/or any present or likely condition that could in any way affect his/her fitness and/or ability to play the sport and participate in the Tournament.
- The Institute has obtained and shall keep current any and all consents required from the Students and their legal guardians to give effect to the terms contained herein, including without limitation in relation to the collection, storage and use of the Student’s personal information by RFYS.
5. Data Collection and Usage
The Institute agrees and acknowledges that RFYS shall be entitled to collect, use and store certain personal information of the Students in the course of the Institute’s registration with RFYS. RFYS’s statement on collection and use of such Student data is available at https://register.rfyouthsports.com/RFYS/Login/privacy (“Privacy Statement”), which is incorporated by reference herein. The Institute recognises that such collection, use and storage of the Student’s personal information is necessary for RFYS to effectively administer the Tournaments, record the performance statistics and results of matches in Tournaments, improve the Tournament format, advertise and promote the Tournament and other uses necessary to support the organisation of Tournaments. The Institute acknowledges the reasonableness of RFYS’s purposes for the collection, and use of Student personal information, and recognises that the RFYS has no direct contractual relationship with the Students. Accordingly, the Institute agrees that it be solely responsible (as between RFYS and the Institute) for and agrees to procure and maintain such consents as may be required or appropriate from Students for the collection use and storage of their personal information by RFYS in accordance with these Terms and the Privacy Statement, and agrees that the grant of such consent shall be a condition to participation and/or continued participation by the Student in RFYS organised/administered Tournaments.
The Institute shall ensure that each Student is provided a copy of the Privacy Statement and has consented to the terms contained therein.
6. Intellectual Property and Proprietary Information
The Institute hereby agrees and acknowledges that all right, title and interest in RFYS intellectual property and proprietary information (including without limitation the Tournaments conducted by RFYS) shall vest with RFYS and that the Institute has no interest of any kind and shall not assert any interest of any kind in such property at any time, whether during or after the Institute’s association with RFYS. In addition, the Institute acknowledges and agrees that all right, title, interest and intellectual property rights in the content created by RFYS which uses any Institute Marks and/or Student Identification, shall vest solely with RFYS.
7. Indemnity
The Institute shall, at its own expense, indemnify, defend and hold harmless RFYS, its directors, personnel, officers, trustees, employees, representatives, agents, and assigns from and against any and all liability (including, but not limited to, liabilities, judgments, damages, losses, claims, costs and expenses, including attorneys’ fees and expenses) any other loss that may occur, arising directly from the breach, malfeasance, misfeasance or deliberate negligence of the Institute and/or any Students in the performance of its obligations under these Terms or if any representations and warranties contained herein are false or inaccurate.
8. Limitation of Liability
To the extent permitted by applicable law, in no event shall RFYS be liable for any special, indirect, consequential, exemplary or incidental damages, however caused, arising out of or relating to these Terms, even if it has been advised of the possibility of such damages. The aggregate liability of RFYS for damages under these Terms, regardless of the form of the action and whether in contract or in tort, including negligence, shall be limited to Rs 5000/-.
9. Term and Termination
The Institute’s association with RFYS shall be valid and subsisting unless terminated earlier as provided herein (“Term”).
RFYS may, at its sole discretion, terminate its association with the Institute with immediate effect, if at any time, the Institute or any of its Students’:
- materially breaches any of the terms contained herein;
- fails to adhere to any direction issued by RFYS pursuant to these Terms;
- is guilty of gross misconduct; or
- is convicted of any criminal offence anywhere in the world
RFYS may, at its sole discretion, direct the Institute to terminate the enrolment of any of its Students in the Tournaments in the event the Student:
- is found guilty of doping or age fraud;
- suffers any permanent incapacity; or
- has been incapacitated from playing the relevant sport by reason of or resulting from an injury or illness (including mental illness or disorder) for a period of one (1) month or more.
RFYS reserves the right at its sole discretion to cancel, terminate, postpone, modify or suspend any of the Tournaments in whole or in part at any time and will not be liable for any consequential losses/damages.
10. Compliance with RFYS and Tournament Rules and Regulations
The Institute agrees and accepts that it shall and shall further ensure that each of the Students comply with these Terms, and all of RFYS’s policies, rules, regulations and instructions as well as any specific rules and regulations for the Tournaments (including without limitation eligibility and selection criteria), that may be notified from time to time and/or as available at www.rfyouthsports.com/rules-regulations (collectively “Regulations”). These Terms are to be read and interpreted in addition to and not in substitution of the Regulations. In the event there is a conflict between these Terms and the Regulations, the Regulations shall prevail. The Institute agrees that the Student’s participation and/or continued participation in a Tournament is subject to such Student’s agreement to adhere to these Terms and the Regulations, and the grant of such rights, approvals and waivers as contemplated within these Terms.
11. Survival
Any provision of these Terms which by its nature must survive the termination of the association between the parties in order to give effect to its meaning shall survive such termination.
12. Applicable Law
These Terms hall be governed by the laws of the Republic of India and the courts of Mumbai, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same. The Institute submits to the exclusive jurisdiction of the courts of Mumbai for the resolution of disputes arising out of these Terms, and agrees not to institute proceedings or petitions (including for injunctive relief) in any court in any other jurisdiction or location.
